The offer and sale of products on our website ("drestige.com") are governed by these General Terms and Conditions of Sale. The products purchased on DRESTIGE.com are sold directly by Drestige Web Srl. 1. Our trade policy

1.1 The Seller offers its own products and those of its partners for sale on drestige.com and carries out its e-commerce business exclusively for its end users who are "consumers".

1.2 When we speak of "consumer" we refer to any natural person who acts on drestige.com for purposes not related to his commercial, entrepreneurial or professional activity, if any. If you are not a "consumer", please refrain from transacting business through drestige.com.

1.3 In view of its commercial policy, the Seller reserves the right not to following orders from subjects other than the "consumer" or in any case orders that do not comply with its commercial policy.

1.4 These General Conditions of Sale exclusively regulate the offer, forwarding and acceptance of purchase orders for products on drestige.com between users of drestige.com and the Seller.

1.5 However, the General Conditions of Sale do not regulate the supply of services or the sale of products by subjects other than the Seller who are present on drestige.com through links, banners or other hypertext links. Before submitting orders and purchasing products and services from parties other than the Seller, we advise you to check their conditions of sale, because the Seller is not responsible for the provision of services by third parties other than the Seller or for the conclusion of electronic commerce between didrestige.com users and third parties.

1.6 Drestige.com reserves the right to refuse orders generated on its site, if it deems that there are no adequate contractual grounds for the seller's policies.

1.7 Drestige.com reserves the right to eliminate or block users if it deems them unsuitable for the contractual sales policies

 

2. How to conclude the contract with DRESTIGE

 

2.1 To conclude the purchase contract for one or more products on drestige.com, you will have to fill in the order form in electronic format and send it to the Seller electronically, following the relative instructions. The sales contract is kept in our archive:

2.2 After concluding the purchase contract for one or more products, by submitting the order form, you will be sent a summary email of the operation which contains a reference to the General Conditions of Sale - Policy - and a summary information on the essential characteristics of each product ordered with the relative price (including all applicable taxes or duties), the means of payment that you can use to purchase each product, the methods of delivery of the products purchased, the methods of handling complaints by the professional, the shipping and delivery costs; as well as the Seller's references and geographic and e-mail address and the date by which the Seller undertakes to deliver the goods. The Seller will also provide you with a summary of the conditions and methods for exercising your right of withdrawal and the methods and times for returning the products purchased (AFTER-SALES SERVICES). You will also be provided with information about the circumstances in which you will lose the right to withdraw from the contract. If applicable to the purchase, you will be informed that, in the event of a withdrawal, you will have to bear the cost of returning the products. In any case, you will be reminded of the existence of the legal guarantee of conformity of the products, you will be provided with the contact details of our after-sales assistance service.

2.3 In the order form, displayed immediately before the conclusion of the purchase contract, we will provide you with summary information about the essential characteristics of each product ordered, the price (including all applicable taxes or duties) and shipping costs ( including any additional costs incurred by you for having chosen a different and/or faster type of shipping and delivery than the standard one). The contract is concluded when the Seller receives your order form electronically, after verifying the correctness of the data relating to your order. The sales contract is kept in our archive.

2.4 In the days following the order, in order to improve the quality of the service offered and the customer experience on drestige.com, we will ask you to rate the service offered through the verified review platforms. This service is offered in collaboration with Zoorate s.r.l. and Trusted Shops AG

2.5 Product Availability

Product availability refers to actual availability at the time the buyer places the order. However, this availability must be considered purely indicative because, due to the simultaneous presence of the products on other online sales channels and in the physical store, they could be sold to other customers before order confirmation.

Even after sending the order confirmation e-mail, there may be cases of partial or total unavailability of the goods. In this case, the order will be automatically adjusted with the elimination of the unavailable product and the buyer will be immediately informed via e-mail.

If the buyer requests the cancellation of the order, resolving the contract, DRESTIGE.COM. will refund the amount paid within 30 days from the moment 

where DRESTIGE.COM . became aware of the buyer's decision to terminate the contract.

Orders will be processed during the following hours: from Monday to Friday, in the following time slot: 9:00 -18:30.

2.5 Billing

The invoice can only be requested at the same time as the order confirmation by filling in the dedicated forms.

The billing request cannot be accepted after the order confirmation or in the following days.

2.6 Safeguard Clause

In the event that one of the clauses of these General Conditions of Sale is void for any reason, this will in no case compromise the validity and compliance with the other provisions contained in these General Conditions of Sale.

2.8 Applicable law and jurisdiction

These General Conditions of Sale are governed by Italian law and interpreted on the basis of it, without prejudice to any other prevailing mandatory rule of the country of habitual residence of the purchaser. Consequently, the interpretation, execution and resolution of the General Conditions of Sale are subject exclusively to Italian law and any disputes relating to and/or consequent to them must be resolved exclusively by the Italian jurisdictional authority. In the event of a dispute, the competent court is without fail attributed to the Court of residence (or domicile) of the Consumer pursuant to Article 66-bis of Legislative Decree 206/2005

  " The Consumer residing in Europe is informed that the European Commission has set up an online platform which provides an alternative dispute resolution tool. This tool can be used by the European Consumer to resolve any dispute relating to contracts for the sale of goods in a non-judicial manner and services stipulated on the network and/or deriving from them (pursuant to European Union Regulation No. 524/2013)

3. Warranties and indication of product prices relation to those products that do not have the relative tag or that have been altered in their essential and qualitative characteristics or that have been damaged, as better clarified in paragraph 8.10.

3.7 The products sold on drestige.com are protected by the legal guarantee of conformity of the products pursuant to art. 128 ff. Consumer Code.

3.7.1. Consumer rights regarding the guarantee on the conformity of the purchased item

3.7.2. The consumer code (Legislative Decree no. 206/2005) in articles 128-135 provides for the obligation to guarantee consumers the conformity of the purchased good with the characteristics and qualities offered. The seller is therefore responsible for any lack of conformity existing at the time of delivery of the goods for all products sold in his shops.

3.7.3. The lack of conformity exists when the product:

     to. does not conform to the description or does not possess the qualities presented by the seller.
     b. finds defects that limit its usual performance (e.g. badly sewn buttons, defective stitching).
3.7.4. The Legal Guarantee only protects the so-called "consumer", i.e. the natural person who, having purchased a product, acts for purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried out and therefore does not apply to products purchased with invoice and VAT number from professionals and companies.

3.7.5. The legal guarantee has a duration of 2 years from the date of delivery of the goods, regardless of the existence of any other guarantees issued by the manufacturer and their duration.
The lack of conformity covered by the legal guarantee that occurs within this period must in any case be reported by the consumer within 2 months from the date of discovery of the defect. In order to ensure that the defect is not the result of incorrect behavior on the part of the buyer:

to. the products must not have been used, worn, washed or damaged;
b. the identification tag must still be attached to the products with the disposable seal;
In the event of a lack of conformity duly reported within the terms, the consumer has the right to have the seller restore the conformity of the goods, free of charge, by means of repair or replacement, or to an appropriate reduction in the price or termination of the contract. In particular, the consumer has the right:

     to. to repair or replace the goods, at his choice, unless the requested remedy is impossible or excessively onerous compared to the other; the requested remedy is "excessively burdensome" when it imposes unreasonable costs on the seller compared to the alternatives, taking into consideration the value of the intact asset, the extent of the defect and the possibility of resorting to alternative remedies without significant inconvenience for the consumer;
     b. alternatively (where the first two remedies are impossible or excessively onerous, or have not been carried out within reasonable terms, or previous repairs or replacements have caused significant inconvenience to the consumer), to request a price reduction or termination of the contract.
3.7.6. The consumer can assert his rights regarding the legal guarantee of conformity by contacting the seller of the goods directly – i.e. Drestige Web Srl or by sending an email to: servizioclienti@drestige.com

 

3.7.7 DRESTIGE's services to end customers

 

The Services we offer allow you to search the DRESTIGE.COM Website and purchase products from a wide range of boutique partners and brands. DRESTIGE.COM also offers: product delivery and dedicated customer service.

Please note that the supply relationship for the product delivery service is between DRESTIGE WEB S.R.L. and the end customer and therefore undertake to conclude a contract for the delivery services offered by us. We may request an additional cost for the performance of these services, which will be indicated at the time of checkout and before confirming the purchase of the products. The contract concluded with us is to be considered fully executed upon delivery of the products by the courier.

Products

DRESTIGE WEB S.R.L. is responsible for the products on sale on www.drestige.com and undertakes to provide as accurate a description as possible of the products offered on DRESTIGE.COM. However, as the descriptions are based on information provided to us by Partners, we cannot guarantee that all details are always accurate, complete or error-free. To get more information about a product, please contact our Customer Service representatives. Product images featured on DRESTIGE.COM are for illustrative purposes only and whilst we try to provide accurate color reproduction, we cannot guarantee that the

reproduction of the images on your monitor reflects the actual color of the products.

We do not allow Partners to offer defective items or products of lower quality than the quality levels usually offered on DRESTIGE.COM. If an item you ordered is not as described, is faulty or is of inferior quality, you can return it to us. Once the item is received a full refund of the faulty product will be issued or alternatively a discount, replacement or repair of the item will be offered where possible, as agreed by us on a case by case basis, therefore the final consumer who purchases on drestige.com with any available payment method will always be subject to protection and guarantee by DRESTIGE.COM

The products sold are supplied exclusively for domestic and private use. You agree not to use the products for commercial purposes or for resale. You also agree not to export, re-export or otherwise transfer the products to any country or territory that is subject to embargoes or sanctions. Neither we nor the Partners can be held responsible for any loss of profit, loss of business, business interruption or loss of business opportunity.

 

Orders, prices and payment

 

The moment you complete the checkout process and place your order by clicking on the "Complete Order" button on the checkout page, you are confirming that you wish to purchase the products on DRESTIGE.COM. Your order is subject to these Terms and Conditions. All orders are subject to availability and order cost confirmation. After concluding the sales contract, DRESTIGE has a legal obligation to supply you with goods compliant with the contract. Legal ownership of the purchased product will pass to you upon acceptance of payment. The inherent risk of the product will continue to be the responsibility of DRESTIGE until the product is delivered to the address indicated at the time of the order.

DRESTIGE allows you to check your order and correct any errors before completing your purchase. We urge you to check and verify your order at each step of the ordering process, as it is your responsibility to ensure that the information you provide is accurate (for example, correct products, quantities, sizes, colours, etc.).

After placing an order, you will receive an e-mail message confirming receipt of the order. This e-mail constitutes an attestation for information purposes only and is not to be considered as acceptance of the order. The contract concluded between you and DRESTIGE.COM regarding the products will only be concluded after our verification. In case of non-confirmation we will promptly inform you and proceed with the cancellation of the order and relative refund if the payment has already been concluded.

DRESTIGE undertakes to provide prices and availability consistent with reality and to ensure that all details, descriptions and prices indicated on DRESTIGE.COM are accurate. If we discover an error in the price of the products ordered, we will inform you promptly and offer you to reconfirm your order at the correct price or cancel it. In which case we are unable to contact you, the order will be considered cancelled. In case of cancellation following the payment of the products, you will receive a full refund as soon as possible.

Delivery costs are not included in the price and, therefore, an additional fee will be charged. Delivery costs (which include the VAT we charge) vary depending on the products ordered and the delivery location. Depending on the delivery location, different tax rules and additional charges may apply. If the items come from a Partner located outside your territory, import charges may apply when the products are delivered. During the checkout phase, you will be informed about the inclusion of customs duties or if it is necessary to pay them once the products are received. If they are not included, neither we nor the Partner have any control over these charges and are unable to advise you on their amount. You will be responsible for paying any such import fees and taxes that are not included. Before placing your order, please contact your local customs office to obtain more information and an "estimate of landed cost".

After verifying your payment details and when we accept and approve your order for delivery, we will send you an e-mail message.

Delivery

 

We will deliver the order within 1-3 days in Italy and 4-7 in the rest of the world from the departure date of the parcel. Shipping times will be shorter if the customer chooses the express service. We will endeavor to ensure that your order is delivered as quickly as possible although, in some circumstances, delivery may be subject to delays due to events beyond our reasonable ability to control. In such cases, we will endeavor to arrange delivery of the products as quickly as possible, but we cannot be held liable for any losses arising from such delays.

Delivery times may vary depending on product availability and delivery location. Delivery times are estimates only and are not guaranteed. The products will be delivered to you directly by the Partners from their offices, so the order can reach you in staggered packages and on different days.

If no one is present at the delivery address to sign for the order, the courier will arrange with you and with our support if required to arrange a new delivery.

 

International Delivery

 

If you are purchasing products bound for an international destination, your order may be subject to applicable import duties and taxes when the package reaches its destination. You are required to comply with all applicable laws and regulations of the country to which the products are intended. We will not be held responsible for any infringement of these laws. However, in most cases the prices of products in non-EU countries include customs duties

 

Order cancellation

 

If you cancel your order (or part of it) during the cooling-off period, you are required to return the product(s) within 14 days of notification of the cancellation, ensuring that the returned item(s) you comply with the conditions set out in our CANCELLATION section If you cancel the contract between us within the 14 day cooling-off period, we will process the refund due as quickly as possible. In any case, the refund will be issued within 14 days from the date of receipt of the goods

 

Final sales and promotional periods

 

SALE or promotional items are not subject to DRESTIGE.COM's standard return and WITHDRAWAL policy and it may not be possible to return them. The possibility of return or refund for Final Sale items purchased on DRESTIGE.com is at the complete discretion of DRESTIGE WEB S.R.L., subject to applicable laws. Furthermore, in case of acceptance of the return, the same could be exclusively charged to the final customer.

3.8.3. Please read the Privacy Policy carefully, which also applies if the user accesses DRESTIGE.com and uses the relative services, but does not purchase any products. Privacy will help you understand how DRESTIGE.com collects and uses your personal data and for what purposes.

3.9. Dispute settlement, ODR and joint settlement

If you have submitted a complaint to us that we have not been able to resolve together, remember that the online consumer dispute resolution service has been established by law.

Jurisdiction
For civil disputes relating to the application of Sections I to IV of this chapter, the mandatory territorial jurisdiction lies with the judge of the place of residence or domicile of the consumer

if located in the territory of the State.

Alternative Dispute Resolution - ALTERNATIVE DISPUTE RESOLUTION (ADR) / ONLINE DISPUTE RESOLUTION (ODR)

According to article 49 paragraph 1 letter V of Legislative Decree 6 September 2005 n. 206 (Consumer Code) the customer who intends to resolve a dispute arising with the merchant can make use of the Joint Conciliation procedure. The Procedure can be initiated if the consumer, after having presented a complaint to the company, within thirty days, has not received a response or has received a response not considered satisfactory by him. Pursuant to art. 14 of Regulation 524/2013, the user is informed that in the event of a dispute, he may file a complaint via the European Union ODR platform which can be reached at the following link http://ec.europa.eu/consumers/odr/. The General Conditions of Sale are governed by Italian law and in particular by the legislative decree 6 September 2005 n. 206, on the consumer code, with specific reference to the legislation on distance contracts and by the legislative decree 9 April 2003 n. 70 on certain aspects concerning electronic commerce.

3.9.1. Editing and updating

The General Conditions of Sale are modified from time to time also in consideration of any regulatory changes. The new General Conditions of Sale will be effective from the date of publication on drestige.com

 

4. Payments

 

4.1 For the payment of the price of the products and the related shipping and delivery costs, you can follow one of the methods indicated in the order form. In no case will you be charged for costs higher than those actually incurred by the Seller, in relation to the payment instrument you have chosen.

4.2 In case of payment by credit card, the financial information (for example, the credit/debit card number or its expiry date) will be forwarded, via encrypted protocol, to the banks, which provide the related electronic payment services remotely, without third parties having access to it in any way. Furthermore, this information will never be used by the Seller except to complete the procedures relating to your purchase and to issue the relative refunds in the event of any product returns, following the exercise of your right of withdrawal, or if it becomes necessary prevent or report to the police the commission of fraud on DRESTIGE.com. The price for the purchase of the products and the shipping and delivery costs, as indicated in the order form, will be charged to your current account upon shipment of the purchased products.

4.3 Cash on delivery cannot be accepted for multiple purchases from different partners.

 

5. COUPONS

 

5.1 COUPONS are personalized codes that allow you to take advantage of a discount on purchases made on DRESTIGE.COM.

5.2 The INSERT COUPON box is displayed on the first page of the purchase process: once the items have been inserted in the SHOPPING BAG, enter your code in the USE A COUPON CODE box and click on APPLY.

5.3 Restrictions on the use of the COUPON A). The value COUPON cannot in any way be converted into cash; B). It will not be possible to use multiple COUPONS in the same order; C). It is not valid for all discount ranges on the site

5.4 If for some reason you are not satisfied with your order, you can return the item on which you applied the COUPON by following the standard return procedure which can be consulted in the Returns section. Once your return has been accepted, you can arrange to receive a new COUPON with our customer service by sending a request to Servizioclienti@drestige.com. To find out the specific methods of shipping and delivering the products, access the Shipping section, at inside the INFORMATION area i. Please pay attention to what is reported in this section because the information contained therein form an integral and substantial part of these General Conditions of Sale and, therefore, are deemed to be fully known and accepted by you at the time the order form is sent.

 

5.5 DRESTIGE GIFT CARDS

 

DRESTIGE Gift Cards are available exclusively online at DRESTIGE.COM.

With the DRESTIGE Gift Card, available in different denominations and colors, you have access to the entire selection of exclusive items and advantageous Drestige promotions.

The perfect gift  for you or for whoever you prefer and that never ceases to amaze.

The Gift Card is valid only for purchases on drestige.com and use requires registration and acceptance of the terms of use.

It is not possible to purchase the Gift Card with cash on delivery or cash on delivery.

The DRESTIGE Gift Card is valid for 12 months from the date the confirmation email is sent, can be used for one or more orders and can also be used for orders with a value higher than that of the DRESTIGE Virtual Gift Card

Purchases using DRESTIGE Gift Cards must be made in the same currency in which the card was issued.

It cannot be redeemed for cash or resold and is not exchangeable. It is recommended to keep it carefully because it can be used by anyone who finds it.

The Gift Card is issued and managed by Drestige Web Srl; the use is regulated by the Italian laws. Drestige Web Srl is not responsible for any loss or damage resulting from loss or theft of the DRESTIGE Gift Card or from unauthorized use of the same.

The DRESTIGE Gift Card code will only be sent to the email address specified at the time of purchase and can only be used with this email address and after contacting customer service at customerservice@drestige.com. DRESTIGE WEB S.R.L. shall not be held responsible in the event of DRESTIGE Gift Cards being sent to an incorrect or incomplete address provided by the purchaser.

The DRESTIGE Gift Card will be sent within 24 hours of payment confirmation in PDF format with the chosen value, remember that the code will only be activated after contacting customer service. To allow shipping within these times, the purchase must be made with an immediate payment system such as credit card or pay pal. The Virtual Gift Cards purchased by bank transfer will be sent to the recipient after receipt of the payment by DRESTIGE.COM.

The codes cannot be combined with other DRESTIGE Gift Card codes and other Credits.

The DRESTIGE Gift Card cannot be used to purchase another Virtual Gift Card and cannot be converted into cash or credit. The customer may request a refund of the DRESTIGE Gift Card purchased, if not used, within 14 days of purchase.

Orders placed with DRESTIGE Gift Cards can be returned; the amount relating to the returned goods will be credited back to the DRESTIGE Gift Card. Orders placed using DRESTIGE Gift Cards are subject to the Commercial Policy, Privacy Policy and Site Regulations published on DRESTIGE.COM.

DRESTIGE.COM reserves the right to refuse orders placed through the use of DRESTIGE Gift Cards that show signs of duplication and fraudulent use.

7. Right of withdrawal

7.1 For purchases outside the E.U. the return is charged to the customer.

7.2 You have the right to withdraw from the contract concluded with the Seller, without any penalty and without specifying the reason, within fourteen (14) days, starting from the day of receipt of the products purchased on DRESTIGE.com. In some specific cases, duly reported in the Right of Withdrawal section, it will be possible to change the chosen garment with another one.

8 To withdraw from the contract you can use the Return Form (compliant with the standard form pursuant to art. 49, paragraph 4 of the consumer code) to be completed and sent directly online through the DRESTIGE.com website, or compiled and sent to Seller other explicit statement of your decision to withdraw from the contract. If you choose to use the Return Form to be sent directly online through the DRESTIGE.com website, the Seller will send you confirmation by e-mail of receipt of the request for withdrawal. If, however, you choose to send another declaration of withdrawal, the burden of proving the correct and timely exercise of the right of withdrawal will fall on you.

8.1 Once the withdrawal from the contract has been exercised, you will have to return the products to the Seller by handing them over to the courier for shipment within fourteen (14) days from when you communicated your decision to withdraw from the contract to the Seller.

8.2 The only expenses charged to you are those for returning the purchased products, unless the Seller has expressly exempted you from such expenses at the time of purchase and on the further condition that you use the shipper indicated by the Seller in the Return Form.

8.3 If you decide to use the shipping agent indicated by the Seller in the Return Form, however, you will not have to personally carry out the payment of the costs, at your expense, for returning the purchased products. The payment of the costs of returning the purchased products will be made, on your behalf, directly by the Seller, who will therefore release you from any payment obligation towards the shipper. The Seller, for the payment of the return, will in fact withhold from the refund a lump sum equal to the standard shipping cost of the products purchased. Furthermore, from the moment of delivery of the purchased products to the shipper indicated by the Seller in the Return Form, the Seller releases you from any liability in the event of loss or damage to the products during transport.

  8.4 If you decide to use a shipping method other than the one indicated by the Seller in the Return Form, you will instead have to pay the costs, at your expense, for returning the purchased products yourself. In this case, an amount equivalent to the cost of the products purchased will be refunded, while any additional costs incurred by you for choosing a different and/or faster type of shipping and delivery than the standard one will not be refunded. In this case, you may be responsible for the loss or damage of the products. Otherwise, the Seller may withhold the products, in addition to the sums already paid for their purchase.

8.5 If, upon delivery of the products previously contracted with the Seller, the buyer refuses delivery of the package (without just cause communicated in time to our customer service: ServizioClienti@DRESTIGE.COM or fails to indicate an exhaustive shipping address will be entitled to a full refund of the sums already paid to the Seller. In this case, a sum equal to the shipping cost will be deducted from the foreseen refund (outbound: to the customer and return: to the Seller. 9. Refund times and methods

 

9.1 After returning the products, the Seller carries out the necessary checks relating to their compliance with the conditions and terms indicated in paragraph 8. In the event that the checks are concluded positively, the Seller sends you, via e-mail, the relative confirmation of acceptance of the returned products. In the event that the checks are not concluded positively, the Seller will inform you, via e-mail, of the found existence of a decrease in the value of the returned products, deriving from your failure to comply with the conditions referred to in letters b) c) and d) of the previous paragraph 8.3. At the same time, the Seller also informs you of the amount that will be deducted from the sums paid by you for the purchase of the returned products; without prejudice, alternatively, to the possibility of re-obtaining, at your expense, the products in the state in which they were returned to the Seller, in accordance with the provisions of paragraph 8.10 above.

9.2 Whatever method of payment you use, the full or partial refund is activated by the Seller in the shortest time possible and in any case within fourteen (14) days from the date on which the Seller became aware of the exercise of your right of withdrawal after verifying the correct execution of your right of withdrawal and verification of the returned products.

9.3 The Seller makes the refund using the same means of payment you used for the purchase of the returned products, unless you have expressly agreed with the Seller to use a different means of payment and on condition that you do not have to pay any additional cost as a result of the refund. If there is no correspondence between the recipient of the products indicated in the order form and the person who paid the sums due for their purchase, the refund of the sums, in the event of exercising the right of withdrawal, will be executed by the Seller, in in any case, against the person who made the payment.

  9.4 The value date of the re-credit is the same as the debit; as a result you will not suffer any loss in terms of bank interest.

9.5 The Seller indicates the shipping agent for returning the products: BRT courier in Italy (http://www.brt.com/) or DHL Sardinia, Sicily and DHL, Boxberry courier in Russia. The customer must use the pre-printed adhesive label attached to the package containing the products (label present only for DHL orders outside Italy), you can return the products ducts to the Seller, without personally paying the necessary expenses. For returns in Italy, the label is placed by the courier upon collection. According to the methods and terms established for the exercise of the right of withdrawal, this method allows the Seller to pay directly, on your behalf, the costs of returning the products purchased, freeing you from any payment obligation towards the shipper. PASSING OF RISK CLAUSE
